Esta Política de Privacidad regula el tratamiento de los datos personales de los usuarios del sitio web tokitek.com y de las aplicaciones de Tokitek, conforme al Reglamento (UE) 2016/679 (RGPD) y a la Ley Orgánica 3/2018 (LOPDGDD).

Datos que tratamos y finalidades
Tratamos únicamente los datos necesarios para cada finalidad, según cómo interactúes con nosotros:
- Sitio web: los datos que nos facilitas en el formulario de contacto (como tu nombre y tu correo electrónico) y los datos técnicos derivados de tu navegación.
- Apps sin registro: la mayoría de nuestras aplicaciones no requieren registro ni datos identificativos para funcionar.
- Apps con registro: en las que requieren cuenta, recogemos únicamente los datos necesarios para crearla y gestionarla (como tu correo electrónico).
- Datos de ubicación: algunas apps solicitan acceso a tu ubicación para ofrecerte funciones basadas en tu posición (por ejemplo, ordenar las playas más cercanas) y para analizar el uso de la app y mejorarla. Este acceso es opcional, solo se utiliza mientras usas activamente la app —no en segundo plano— y puedes revocarlo en cualquier momento desde los ajustes de tu dispositivo. Los datos de uso pueden asociarse a un identificador del dispositivo y se tratan mediante analítica propia, de forma agregada y sin compartirse con terceros, únicamente para mejorar la app y sin emplearse para identificarte personalmente.
Cada tratamiento se ampara en una base legal:
- Atender tus consultas y solicitudes — consentimiento o medidas precontractuales (art. 6.1.a y 6.1.b RGPD).
- Prestar y mantener los servicios y funcionalidades que solicitas — ejecución del contrato o relación de servicio (art. 6.1.b RGPD).
- Mantener y mejorar la seguridad y el funcionamiento de nuestros servicios — interés legítimo en garantizar la seguridad de nuestros sistemas, prevenir usos fraudulentos o abusivos y mejorar nuestros servicios (art. 6.1.f RGPD).
- Cumplir las obligaciones legales que nos resulten aplicables — obligación legal (art. 6.1.c RGPD).
No tratamos datos de categorías especiales ni datos de menores de 14 años. Facilitar los datos solicitados es voluntario; su no aportación puede impedir la prestación del servicio correspondiente. No adoptamos decisiones automatizadas ni elaboramos perfiles con efectos jurídicos sobre ti.
Conservación y seguridad
Conservamos los datos durante el tiempo necesario para cumplir la finalidad para la que se recogieron y, posteriormente, durante los plazos legalmente exigibles. Cuando dejan de ser necesarios, los suprimimos o anonimizamos.
Aplicamos las medidas técnicas y organizativas adecuadas para garantizar un nivel de seguridad apropiado al riesgo, conforme al art. 32 del RGPD.
Destinatarios y transferencias
No cedemos tus datos a terceros, salvo obligación legal o cuando resulte necesario para prestar el servicio a través de proveedores que actúan como encargados del tratamiento conforme al RGPD. Si alguno de ellos realiza transferencias fuera del Espacio Económico Europeo, se llevarán a cabo con las garantías exigidas por la normativa.

Cuando el tratamiento se base en tu consentimiento, puedes retirarlo en cualquier momento sin que ello afecte a la licitud del tratamiento previo.

Tratatzen ditugun datuak eta helburuak
Helburu bakoitzerako beharrezkoak diren datuak soilik tratatzen ditugu, gurekin nola elkarreragiten duzun arabera:
- Webgunea: kontaktu-formularioan ematen dizkiguzun datuak (zure izena eta posta elektronikoa, adibidez) eta zure nabigaziotik eratorritako datu teknikoak.
- Erregistrorik gabeko appak: gure aplikazio gehienek ez dute erregistrorik ez datu identifikatzailerik behar funtzionatzeko.
- Erregistrodun appak: kontua behar dutenetan, hura sortzeko eta kudeatzeko beharrezko datuak soilik biltzen ditugu (posta elektronikoa, adibidez).
- Kokapen-datuak: app batzuek zure kokapenerako sarbidea eskatzen dute zure posizioan oinarritutako funtzioak eskaintzeko (adibidez, hurbilen dauden hondartzak ordenatzeko) eta appen erabilera aztertzeko eta hobetzeko. Sarbide hori aukerakoa da, appa aktiboki erabiltzen duzun bitartean soilik erabiltzen da —ez bigarren planoan— eta edozein unetan ezezta dezakezu zure gailuaren ezarpenetatik. Erabilera-datuak gailuaren identifikatzaile batekin lotu daitezke eta analitika propioaren bidez tratatzen dira, modu agregatuan eta hirugarrenekin partekatu gabe, appa hobetzeko soilik eta zu pertsonalki identifikatzeko erabili gabe.
Tratamendu bakoitzak oinarri juridiko bat du:
- Zure kontsultak eta eskaerak erantzutea — adostasuna edo kontratu aurreko neurriak (DBEO 6.1.a eta 6.1.b art.).
- Eskatzen dituzun zerbitzuak eta funtzionalitateak ematea eta mantentzea — kontratuaren betearazpena edo zerbitzu-harremana (DBEO 6.1.b art.).
- Gure zerbitzuen segurtasuna eta funtzionamendua mantentzea eta hobetzea — gure sistemen segurtasuna bermatzeko, erabilera iruzurtia edo gehiegizkoa saihesteko eta gure zerbitzuak hobetzeko interes legitimoa (DBEO 6.1.f art.).
- Aplikatzen zaizkigun lege-betebeharrak betetzea — lege-betebeharra (DBEO 6.1.c art.).
Ez dugu kategoria bereziko daturik tratatzen, ezta 14 urtetik beherako adingabeen daturik ere. Eskatutako datuak ematea borondatezkoa da; ez ematea dagokion zerbitzua ematea galaraz dezake. Ez dugu erabaki automatizaturik hartzen, ezta zugan ondorio juridikoak dituen profilik egiten ere.
Kontserbazioa eta segurtasuna
Datuak biltzeko helburua betetzeko behar den denboran gordetzen ditugu eta, ondoren, legez eskatutako epeetan. Beharrezkoak izateari uzten diotenean, ezabatu edo anonimizatu egiten ditugu.
Arriskuaren araberako segurtasun-maila egokia bermatzeko neurri tekniko eta antolakuntzakoak aplikatzen ditugu, DBEOren 32. artikuluaren arabera.
Hartzaileak eta transferentziak
Ez dizkiogu zure datuak hirugarrenei lagatzen, lege-betebeharra dagoenean edo zerbitzua emateko beharrezkoa denean izan ezik, DBEOren arabera tratamenduaren arduradun gisa jarduten duten hornitzaileen bidez. Horietakoren batek Europar Esparru Ekonomikotik kanpoko transferentziak egiten baditu, araudiak eskatutako bermeekin egingo dira.

Data we process and purposes
We process only the data necessary for each purpose, depending on how you interact with us:
- Website: the data you provide in the contact form (such as your name and email address) and the technical data derived from your browsing.
- Apps without registration: most of our applications do not require registration or identifying data to work.
- Apps with registration: for those that require an account, we collect only the data needed to create and manage it (such as your email address).
- Location data: some apps request access to your location to provide position-based features (for example, sorting the nearest beaches) and to analyse app usage and improve it. This access is optional, is only used while you are actively using the app —not in the background— and you can revoke it at any time in your device settings. Usage data may be linked to a device identifier and is processed with our own (first-party) analytics, in aggregate and without being shared with third parties, solely to improve the app and without being used to identify you personally.
Each processing activity relies on a legal basis:
- Responding to your enquiries and requests — consent or pre-contractual measures (Art. 6.1.a and 6.1.b GDPR).
- Providing and maintaining the services and features you request — performance of a contract or service relationship (Art. 6.1.b GDPR).
- Maintaining and improving the security and operation of our services — legitimate interest in keeping our systems secure, preventing fraudulent or abusive use and improving our services (Art. 6.1.f GDPR).
- Complying with the legal obligations applicable to us — legal obligation (Art. 6.1.c GDPR).
We do not process special categories of data or data of children under 14. Providing the requested data is voluntary; failing to provide it may prevent us from delivering the relevant service. We do not make automated decisions or carry out profiling with legal effects on you.
Retention and security
We keep the data for as long as necessary to fulfil the purpose for which it was collected and, thereafter, for the periods required by law. Once it is no longer needed, we delete or anonymise it.
We apply appropriate technical and organisational measures to ensure a level of security appropriate to the risk, in accordance with Art. 32 GDPR.
Recipients and transfers
We do not share your data with third parties, except where required by law or where necessary to provide the service through providers acting as data processors under the GDPR. If any of them carries out transfers outside the European Economic Area, these will be made with the safeguards required by the regulation.
